Welcome to joliejolie.eu (“JolieJolie”, “we”, “us”, “our”). These Terms and Conditions govern your access to and use of the JolieJolie platform, including our website, mobile applications, and all related services. By registering for an account or using our services, you agree to be bound by these Terms.
1. About JolieJolie
JolieJolie is an online retail store selling jewellery and accessories directly to customers (“Customers”). JolieJolie provides the technology infrastructure and tools, including AI-powered features, but does not itself sell, manufacture, or ship any products.
2. Eligibility
To use JolieJolie, you must:
- Be at least 18 years of age.
- Have the legal capacity to enter into a binding agreement.
- Provide accurate and complete registration information.
- If registering as a Seller, hold a valid business registration or equivalent documentation as required by applicable law.
3. Account Registration
You must create an account to access most features of the platform. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4. Seller Accounts
Sellers may create and manage their own online showrooms on JolieJolie. By registering as a Seller, you agree to:
- Provide accurate product descriptions, images, pricing, and availability information.
- Comply with all applicable laws and regulations, including consumer protection, product safety, and tax obligations.
- Fulfill orders in a timely manner and handle customer service, returns, and disputes related to your products.
- Not list counterfeit, illegal, or prohibited items.
JolieJolie reserves the right to suspend or terminate Seller accounts that violate these Terms or engage in fraudulent activity.
5. Buyer Accounts
Buyers may browse seller showrooms, place orders, and communicate with sellers through the platform. Buyers acknowledge that all transactions are between the Buyer and the respective Seller. JolieJolie is not a party to any transaction between Buyers and Sellers.
6. Pricing and Payments
All prices displayed on the platform are set by the respective Sellers and are shown in the currency indicated at the time of listing. JolieJolie does not control or guarantee the accuracy of Seller pricing. Payment processing is handled through third-party payment providers (including Stripe and PayPal). By making a purchase, you agree to the terms of the applicable payment provider.
7. Subscription Plans and AI Tokens
Sellers may subscribe to paid plans that provide additional features and monthly AI token credits. Subscription fees are billed monthly through Stripe. AI tokens are used for platform features such as AI-powered product uploads and analytics. Tokens do not carry over between billing cycles unless otherwise stated. 8. Commission
JolieJolie operates on a zero-commission model. Sellers keep 100% of their sales revenue. Revenue for JolieJolie is generated through subscription fees and AI token purchases.
9. AI-Powered Features
JolieJolie provides AI-powered tools for product upload assistance, analytics, and recommendations. While we strive for accuracy, AI-generated content (such as product descriptions or category suggestions) is provided as a starting point and should be reviewed by Sellers before publishing. JolieJolie is not responsible for any inaccuracies in AI-generated content.
10. Private Showrooms
Sellers may configure their showrooms as private, restricting access to approved buyers only. JolieJolie respects seller privacy settings and does not share private catalog information with unauthorized users. Buyers who are granted access to a private showroom must not share or redistribute the catalog content without the Seller’s consent.
11. Intellectual Property
All content on the JolieJolie platform, including the logo, design, software, text, and graphics, is the property of JolieJolie or its licensors and is protected by intellectual property laws. Sellers retain ownership of their product images, descriptions, and branding. By uploading content, Sellers grant JolieJolie a non-exclusive, worldwide license to display and promote their products on the platform.
12. Prohibited Conduct
You agree not to:
- Use the platform for any unlawful purpose.
- Upload or transmit viruses, malware, or harmful code.
- Attempt to gain unauthorized access to other accounts or platform systems.
- Scrape, crawl, or collect data from the platform without authorization.
- Interfere with or disrupt the platform’s operation.
- Impersonate any person or entity.
- List counterfeit or stolen goods.
13. Limitation of Liability
JolieJolie provides the platform “as is” and “as available.” To the maximum extent permitted by law, JolieJolie shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to loss of profits, data, or business opportunities. JolieJolie’s total liability shall not exceed the amount paid by you to JolieJolie in the twelve (12) months preceding the claim.
14. Disputes Between Buyers and Sellers
JolieJolie is not responsible for resolving disputes between Buyers and Sellers regarding product quality, delivery, refunds, or any other transaction-related matter. We encourage Buyers and Sellers to communicate directly to resolve any issues. JolieJolie may, at its sole discretion, offer mediation assistance but is not obligated to do so.
15. Data Protection and Privacy
We collect, process, and store personal data in accordance with our Privacy Policy and applicable data protection laws, including the EU General Data Protection Regulation (GDPR). By using our platform, you consent to our data practices as described in our Privacy Policy.
16. Termination
We may suspend or terminate your account at any time if you violate these Terms or if we determine, at our sole discretion, that your continued use poses a risk to the platform or other users. You may close your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately.
17. Modifications
JolieJolie reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated “Last updated” date. Continued use of the platform after any modifications constitutes acceptance of the revised Terms. We will notify registered users of material changes via email.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Cyprus and the European Union. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Nicosia, Cyprus.
